GENERAL TERMS AND CONDITIONS

These General Terms and Conditions (hereinafter: "T&C") govern the rights and obligations of the Customer (hereinafter: "Buyer") who uses the electronic commerce services provided through the online store operated by Herz Vanilla Hungary Kft. (hereinafter: "Service Provider", "Herz New York Coffee Roasters").

The T&C acceptance is a prerequisite for accessing the Service available on the Website, i.e., placing orders and making purchases. By using the Service, the Buyer accepts and acknowledges as binding the present T&C, as well as the Privacy and Data Processing Policy (hereinafter: "Policy"). The Policy is an integral part of these T&C and should be interpreted in accordance with its provisions.

  1. Scope and Modification of T&C

The Service Provider is entitled to modify these T&C, in part or in full, at any time. The Service Provider will notify visitors and users of the Website of the latest modification by posting a brief announcement on the homepage. The T&C and its modifications come into effect when they are published, and by starting to use the Service after such publication, the Website visitor or user accepts and is bound by the current modified T&C.

2.1 Conditions for Service Use
The Service available through the Website is only available to natural persons over the age of 18, and legally registered non-natural persons.

  1. Agreement between the Service Provider and the Buyer

3.1 Purchase Process
The Buyer can place an order for one or more products available on the Website. As part of the purchase, the Buyer provides personal information, preferred delivery, and payment methods. Before finalizing the order, the Buyer can review the data on the summary screen. The Buyer will receive a notification at the provided email address upon successful order placement. The Buyer is solely responsible for any delivery issues or additional costs and/or damages resulting from incorrect or inaccurate information provided by them. The Service Provider cannot always track changes in delivery details after the order has been placed and therefore does not take responsibility for any resulting delays, inconvenience, or damages. The Service Provider also assumes no responsibility for unauthorized access to personal data or payment card information provided on the OTP Mobil - Simple Pay banking interface.

3.2 Order Confirmation and Cancellation
Upon receiving an order, if the Buyer’s data is unclear or questionable, the Service Provider may contact the Buyer through the registered phone number or email for data verification. In the case of unsuccessful data verification, the Service Provider is entitled to cancel the order and notify the Buyer at the registered email address.

3.3 Payment Methods
The Buyer can pay for the order via internet banking using a credit card, or by cash on delivery. For personal pickup, only internet banking payment is possible. The Service Provider will display the delivery cost to the user when the order is confirmed. An e-invoice will be sent via the szamlazz.hu system within 24 hours of payment. If the order’s payment is not made by credit card or cash, the Service Provider has the right to refuse to fulfill or deliver the order until the payment is complete.

3.4 Responsibility for Online Payment Platform
The Service Provider is not responsible for any malfunctions in the online payment platform provided by the Bank, and any indirect or direct damages caused by such malfunctions. The Buyer should contact the Bank directly for any issues related to the payment platform.

3.5 Product Pricing
The Service Provider offers products at the prices displayed on the Website, which include VAT. The Service Provider may change these prices at any time, but these changes do not affect already confirmed orders. In case of a system error or external factors causing an incorrect price to be displayed, the Service Provider is not obliged to sell the item(s) at the wrong price but may offer the correct price to the Buyer, who can either accept or reject the new price.

3.6 Home Delivery
The detailed description of home delivery and its cost will be published on the Website by the Service Provider, and it forms part of these T&C.

  1. Buyer’s Rights, Obligations, and Right of Withdrawal
    According to Government Decree 45/2014. (II. 26.) on contracts concluded with consumers at a distance, the Buyer has the right to withdraw from the contract without justification within 14 working days from the receipt of the ordered goods. The right to withdraw applies to contracts for the sale of goods: "The period shall end 14 days after the day on which you or a third party indicated by you, other than the carrier, takes possession of the goods." In case of withdrawal, the only cost for the Buyer is the return shipping cost. The Service Provider will refund the purchase price to the Buyer no later than 14 days after receiving the returned goods. The Buyer must exercise the right of withdrawal in good faith and without abusing it. In case of misuse, the Service Provider is not obliged to refund the price or accept the return. Only unused, undamaged, and complete products in their original packaging can be returned. Shipping costs for returning goods or for exchanging goods are the Buyer’s responsibility. The Buyer must notify the Service Provider of their intention to withdraw via email at sales@herzcoffee.com. The Service Provider will refund the Buyer within 14 days of receiving the returned item or upon confirmation that the item has been returned.

  2. Guarantees on the Website
    While the Service Provider strives to ensure the continuous availability and functionality of the Website, it cannot guarantee its uninterrupted operation. The Service Provider is not responsible for any direct or indirect damages caused by technical failures, outages, or malware inserted by third parties. The Service Provider will take all necessary precautions to ensure the safety, reliability, and security of the Website.

  3. Copyrights
    All content on the Website, including data, information, images, descriptions, texts, and design, is the exclusive property of the Service Provider and is protected by copyright. Any use of these materials without the prior written consent of the Service Provider violates copyright laws and may lead to legal consequences. Referencing the Website on other platforms is allowed, provided that the Website is not presented as part of another site.

  4. Complaints and Dispute Resolution
    The Buyer can file complaints related to the product or the Service Provider’s activities by contacting sales@herzcoffee.com.

7.1 Complaint Handling
The Service Provider will respond substantively to any complaint submitted within 48 hours (excluding non-working days) after receiving it.

7.2 Other Legal Remedies
If a dispute between the Buyer and the Service Provider is not resolved during negotiations, the Buyer has the following legal remedies: Filing a complaint with consumer protection authorities, initiating proceedings with the Conciliation Board, or filing a lawsuit. The Service Provider may modify these T&C unilaterally, and any such modification will take effect when published on the Website.
